Personal Data Privacy Notice

1. Data controller

Under Turkish Personal Data Protection Law No. 6698 (“KVKK”), your personal data is processed by Mert Yapı Yaşam as the data controller.

2. Personal data processed

The following personal data may be processed through the “Let’s Evaluate Your Building Together” form:

  • Identity and contact information: Full name, phone number and email address.
  • Professional and relationship information: Property owner, building manager/representative, landowner or another role you specify.
  • Property and project information: District, neighbourhood, building/complex name, approximate building age, number of independent units and building risk assessment information.
  • Request and process information: The stage of the transformation process, your priority needs, explanations and contact preference.
  • Document information: Information contained in documents and images you upload voluntarily.
  • Transaction security information: Date and time, IP address and security records that may be generated when the form is submitted.

Please do not include unnecessary third-party data or sensitive personal data in document or description fields.

3. Purposes for processing personal data

Your personal data is processed to receive and respond to your request, conduct an initial assessment of your building, contact you, plan meetings and proposals, provide requested services, maintain records and information security, fulfil legal obligations, and exercise or protect our rights in potential disputes.

Campaigns and announcements are sent only on the basis of your separate consent to commercial electronic communications. Withholding this consent does not affect your assessment request.

4. Collection method and legal grounds

Your personal data is collected electronically, wholly or partly by automated means, when you complete this online form and optionally upload documents.

Your data is processed on the legal grounds set out in Article 5 of the KVKK, including necessity for establishing or performing a contract, fulfilling the data controller’s legal obligations, establishing, exercising or protecting a right, and our legitimate interests provided your fundamental rights are not harmed. Commercial electronic communications are based on your explicit consent.

5. Transfer of personal data

Your personal data may be transferred, only as required for the stated purposes, to our authorised employees; suppliers providing IT, hosting, communication, file storage and security services; legal, financial and technical advisers where necessary; and legally authorised public institutions and judicial authorities.

If data must be transferred abroad because technical service providers are located outside Türkiye, the transfer conditions and appropriate safeguards under Article 9 of the KVKK will apply.

6. Retention period

Your data is retained for the period required by the assessment and communication process and in line with statutory limitation and retention periods. Once the reason for retention no longer exists, personal data is deleted, destroyed or anonymised in accordance with the law. If you withdraw consent for commercial communications, data based on that consent will no longer be used for marketing, subject to statutory record-keeping obligations.

7. Your rights under the KVKK

Under Article 11 of the KVKK, you may apply to the Company to learn whether your personal data is processed; request information if it is; learn the purpose of processing and whether it is used accordingly; learn the third parties to whom it is transferred in Türkiye or abroad; request correction of incomplete or inaccurate data; request deletion or destruction under the conditions of the Law; request notification of correction, deletion or destruction to third parties receiving the data; object to an adverse result arising solely from automated analysis; and claim compensation for damage caused by unlawful processing.

8. Applications

You may submit your requests with information and documents sufficient to verify your identity, in writing to the postal address above or by using the email address registered in our systems, to sizidinliyoruz@mertyapiyasam.com . Applications will be concluded as soon as possible and no later than 30 days, depending on the nature of the request.
